EL 30 DE NOVIEMBRE DE 2022, el Tribunal Constitucional no se limitará a decidir sobre la legitimidad constitucional de la exigencia de la vacuna Covid-19, sino que establecerá si los principios fundamentales y los derechos humanos considerados intangibles por nuestra Constitución deben seguir considerándose sagrados e inviolables o se convertirán en declaraciones estériles sobre un papel muerto.
El 30 de noviembre, la Consulta decidirá si a partir de entonces podremos seguir considerándonos dueños de nuestro cuerpo y autodeterminar nuestra elección de tratamiento o si, por el contrario, nuestro cuerpo pasará a ser propiedad del Estado.
Los promotores del Comité “In cammino per la Costituzione” (En camino hacia la Constitución) anuncian la puesta en marcha de un camino destinado a revivir los debates que animaron y apasionaron a los Padres Constituyentes en 1946-1948, de los que emerge la esencia misma de los principios de libertad y centralidad del individuo que representan el motivo fundacional y el corazón palpitante de nuestra Constitución.
Queremos que esos principios vuelvan a cobrar vida, queremos que vuelvan al corazón de los ciudadanos y de los juristas, queremos detener y superar la distorsión progresiva intencionada de nuestra hermosa Carta para devolverle su esplendor original.
Durante todo el mes de noviembre, los promotores de In cammino per la Costituzione estarán en los lugares donde se decidirá la suerte de nuestro Estado de Derecho para contar no sólo una historia, sino LA historia de nuestra Constitución, hasta la noche del 29 de noviembre, cuando el Comité se reunirá en una vigilia de silencio y luz, esperando la decisión de la Consulta.
Queremos agradecer de antemano a todos aquellos que, por diversos motivos, quieran sumarse a la iniciativa y quieran apoyarnos en la organización.

OBLIGACIÓN DE VACUNACIÓN PARA PROTEGER LA SALUD
El Tribunal consideró inadmisible, por razones procesales, la cuestión de si los profesionales sanitarios que no han cumplido la obligación de vacunación estén incapacitados para desempeñar su trabajo, cuando éste no implica contacto interpersonal.
En cambio, las opciones del legislador ADOPTADAS EN EL PERÍODO PANDÉMICO sobre la obligación de vacunación de los profesionales sanitarios no se consideraron irrazonables ni desproporcionadas.
Igualmente infundados, por último, fueron los cuestionamientos propuestos con referencia a la disposición que excluye, en caso de incumplimiento de la obligación de vacunación y por el tiempo de suspensión, el pago de un subsidio patronal para quienes hayan sido suspendidos; y esto, tanto para el personal sanitario como para el escolar.
Esto es todo lo que tiene que decir la Oficina de Comunicación y Prensa del Tribunal Constitucional, a la espera de que se presenten las sentencias.
